Telstra "Name In Lights" Promotion - Terms and Conditions
We’re delighted that you want to enter the Telstra “Name In Lights” promotion to win free advertising exposure for your business.
This promotion is being run by Telstra Corporation Limited (ABN 33 051 775 556) of Level 24, 242 Exhibition St, Melbourne, VIC 3000, Australia. ("we", “us” or “our”).
By submitting an entry to this promotion, you are deemed to have accepted these terms and conditions on behalf of your business or employer, and you warrant to us that you have authority to enter this promotion on behalf of your business or employer.
As with any fair competition, if you don’t comply with these terms, we have the right to disqualify you or declare your entry ineligible so it’s important to take note of these terms.
This promotion is a game of skill. Chance plays no part in the outcome.
When can you enter?
The promotion starts at 9am AEDST on Tuesday 2 March 2021 and ends at 11.59pm AEDST on Tuesday 23 March 2021 ("promotion period"). No entries will be accepted after this time.
Who can enter?
Entry is open to all active, current Telstra Small Business customers with no less than 3 months continuous billing history as at the date of entry (i.e. who have been active customers continuously since at least December 2020) (3 Month Test) and with a registered Australian Business Number (ABN), other than our officers, employees or contractors and other companies associated with the promotion, and their immediate families.
For your entry to be valid, you must be a current director or employee of a small business that meets all of the following requirements:
it must meet the 3 Month Test
it must carry on business in Australia;
it must have an Australian Business Number;
it must have been in operation for at least 12 months as at the time of entry;
it must be more than 60% Australian owned, with the owners or founders responsible for making the key management decisions;
it must have fewer than 100 full-time equivalent staff at the end of the promotion period; and
be using a business name, logo and/or trade mark (as relevant) that is registered to or properly licensed to it.
Your entry will not be valid and may be disqualified if any of the following apply to the small business:
More than half of its shares or assets are owned by another business
It has been placed in administration or liquidation in the 5 years before the end of the promotion period or has been subject to court proceedings in the 12 months before the end of the promotion period, including action against any of the business’s owners, founders or directors in their personal capacity
it is affiliated with Telstra through investments or donations
it is a government agency
it has been subject to a third party challenge regarding the use of its business name, logo and/or trade mark
How do you enter?
To enter the promotion, you must complete each of the following steps during the promotion period:
visit our online hub at www.telstra.com.au/nameinlights (“Website”);
book a “Telstra Business Go Digital Consult” OR register your interest and we'll be in touch to schedule a consultation;
answer the following question “in 100 words or less, tell us why your business could really use having its name up in lights.” (“entry question”); and
complete all the required fields.
Only one entry per business will be accepted. Entries are accepted at the time of receipt by us. If more than one entry is received for the same business, the first entry only is valid (subject to meeting all other validity requirements).
Incomplete, indecipherable or illegible entries will be deemed to be invalid. We may also disqualify entries that do not comply with these terms and conditions.
Your entry must not contain offensive or defamatory comments, breach any law or infringe any third party rights, including intellectual property rights. You grant us a royalty free, perpetual and irrevocable licence to use, modify, adapt and publish your entry. In particular, we may use your entry for promotional and marketing purposes.
Judging of entries
Judging will take place at Telstra on Friday 26 March 2021.
The winners will be chosen based on the 67 valid entries judged by the promoter to be the most creative answers to the entry question, as determined by the judges in their sole discretion. Note, this is a game of skill only and chance plays no part in determining the winners. The outcome of any “Telstra Business Go Digital Consult has no bearing on the selection of the winners.
The judges will rank the entries in terms of their creativity and distribute the total prize pool accordingly.
The judge’s decision is final and binding and no correspondence will be entered into.
Any prize is awarded to the small business and not to any individual in their personal capacity. The promoter will communicate with appropriate personnel from the winning small businesses with respect to fulfilling their prize, which may not be the individual director or employee who submitted the entry.
The Prize Pool
The total prize pool consists of 67 prizes:
9 x Australian Football League (AFL) Major Prizes: to be delivered during Round 8 of the 2021 Toyota AFL Premiership
8 x National Rugby League (NRL) Major Prizes: to be delivered during Round 9 of the 2021 NRL Telstra Premiership
50 x Minor Prizes: to be delivered by Telstra across select Telstra Retail and Digital environments.
For the avoidance of doubt, the 9 most creative answers will be awarded one AFL Major Prize each, the next 8 most creative answers will be awarded one NRL Major Prize each, and the next 50 most creative answers will be awarded one Minor Prize each.
The Major Prize – AFL
Nine major prize winners will receive advertising exposure for their business at the relevant sporting venue during a Round 8 fixture of the 2021 Toyota AFL Premiership (each “prize”). The total prize value is variable and depends on which AFL Round 8 fixture is assigned to each of the nine major prize winners.
Each of these 9 major prizes includes:
the winning business’s business name and/or logo to feature on:
Stadium Perimeter LED Advertising Boards;
AFL Club Banner; and,
Stadium Big Screen.
the winning business’s business name and/or logo may also, at the Promoter’s discretion, feature across other advertising placements including, but not limited to:
the live Channel 7 AFL Broadcast;
Official AFL, AFL Club, AFL Men Listed Players and Telstra Digital and Social Media Channels; and,
Official match day promotions conducted by the relevant AFL Club
A corporate hospitality package at the applicable sporting venue for 10 people selected by the winning business which includes:
Match day corporate hospitality function, inclusive of a match day ticket and all food and beverage; and,
Participation in the “Guard of Honour” for one of the two AFL Clubs playing in the designated Round 8 Fixture.
The prize is valid for Round 8 of the 2021 Toyota AFL Premiership only. The dates and times for each Round 8 fixture of the 2021 Toyota AFL Premiership Season will be published by the Australian Football League at www.afl.com.au/fixture. Entrants should check this site for updates. The 2021 Toyota AFL Premiership Season fixture is subject to change by the Australian Football League, including in relation to the impact of COVID-19. At the time of writing these terms and conditions, the commencement of Round 8 of the 2021 Toyota AFL Premiership Season is estimated to be on Friday 7 May 2021.
Which fixture is assigned to which winning business is entirely at the promoter’s discretion. Each fixture is considered to be equally valuable regardless of which AFL Clubs are playing, whether it is a televised fixture and whether or not TV or social media exposure is provided. No correspondence will be entered into as to which fixture is assigned to which winning business.
The prize is not exchangeable, transferrable or redeemable for cash.
If any transport, travel or accommodation is required for the individuals selected by the winning business to attend the fixture, this is at the individuals’ or the winning business’s own expense. The prize does not include any transport, travel or accommodation to attend the fixture.
The Major Prize – NRL
Eight major prize winners will receive advertising exposure for their business during a Round 9 match of the 2021 NRL Telstra Premiership (each “prize”). The total prize value is variable and depends on which NRL Round 9 match is assigned to each of the eight major prize winners.
The prizes are:
the winning business’s business name and/or logo to feature on:
Virtual Grass Advertising Signage;
Stadium Perimeter LED Advertising Boards; and,
Stadium Big Screen.
the winning business’s business name and/or logo may also, at the promoter’s discretion, feature across other advertising placements including, but not limited to:
the live Channel 9 NRL Broadcast;
Official NRL, NRL Club, NRL Men Listed Players and Telstra Digital and Social Media Channels; and,
Official match day promotions conducted by the relevant NRL Club.
A corporate hospitality package at the applicable sporting venue for 10 people selected by the winning business which includes which includes:

Which match is assigned to which winning business is entirely at the promoter’s discretion. Minor Prize – 50 x Telstra Retail Store Advertising
Each one of 50 minor prize winners will receive promotion for their business at their local Telstra Store, in the My Telstra App and on Telstra.com (each “prize”). The prize includes:
the winning business’s business name and/or logo to feature on:
Internal and or external digital screen at their closest Telstra retail store between 10 May 2021 and 30 June 2021 (potentially in rotation with other information or advertising)
A tile featuring the winning business’s business name and/or logo within the “Telstra News’ section of the My Telstra App which will click through to an article about the Telstra “Name In Lights” promotion” mentioning the winning business for approximately [four weeks] at a time of the promoter’s choosing before 30 June 2021.
A tile featuring the winning business’s business name and/or logo within the ‘Latest news and updates’ News space on the Telstra.com website which will click through to an article about the Telstra “Name In Lights” “Big promotion mentioning the winning business for approximately [four weeks] at a time of the promoter’s choosing before 30 June 2021.
Prize value
While it is not possible to provide precise estimates of individual prizes, the estimated value of the total prize pool is $1 million (plus GST).
Prize Fulfilment
The way the major prize winner’s business name and/or logo is featured across the advertising placements is at the promoter’s discretion. It is the winner’s responsibility to provide their logo in high resolution format, brand guidelines and required business information to Telstra within 48 hours of us requesting it. The promoter will use its best endeavours to ensure the business name and/or logo are accurately portrayed, but no approval will be sought from the winning business for any draft or final artworks. The winning business grants Telstra a royalty-free licence to use and display its logo and business name for the purposes of fulfilling the prize. (Telstra may require the winning business to execute a reasonable written licence as a condition of providing the prize.)
Intellectual Property indemnity
It is a condition of receiving a prize that the winning business indemnify Telstra against all claims (whether successful or not) by third parties that the use of the winning business’s business name or logo infringes the third party’s intellectual property rights in any way, including for any legal costs, damages, expenses, penalties or other losses Telstra suffers. (Telstra may require the winning business to confirm its acceptance of these terms in writing as a condition of providing the prize.) If the winning business does not own the copyright in its business name or logo, it must provide proof to Telstra that it has a licence that enables it to sub-license the right to use the business name and logo as required by these terms.
Notification of the winners
Each winning business will be notified by telephone and email on Wednesday 31 March 2021. The names of the winning businesses will be published on the website on Monday 12 April 2021.
Photographs, videos and comments from the winners
If you are a winning business, we may contact the person who entered on your behalf or other personnel about the promotion, and take photos and/or videos of your representatives, and use their comments and photos for promotional and marketing purposes. If we do so, you grant us a royalty free, perpetual and irrevocable licence to use these comments and the photos for such purposes (and must assist us to obtain similar licences from any individuals).
Use and disclosure of your information
We may use and disclose the information you provide in submitting an entry (and other information provided by the winning business about individuals) on the terms and for the purposes set out in our Privacy Statement, and as required to conduct this promotion, which may include disclosing that information to prize suppliers. Supply of an alternative prize
Except where we suspend or cancel the promotion (see below), if we are unable to provide a winner with a prize (or part of a prize) as described, we will use reasonable endeavours supply an alternative prize (or part of a prize) of similar monetary value.
If a prize is not claimed
If a prize has not been claimed by 11.59pm AEDST on Thursday 1 April 2021 it will be distributed at our absolute discretion.
Suspension, cancellation, modification or termination of the promotion
If for any reason beyond our reasonable control, we are not able to conduct the promotion as anticipated, we may suspend, modify, terminate or cancel the promotion unless to do so would be prohibited by law.
Liability excluded
To the extent permitted by law, we will not be liable for any loss or damage or personal injury suffered or sustained in connection with the promotion including a prize or the taking of a prize. We accept no responsibility for any tax liabilities that may arise from winning a prize.
